Terms of Service

Rules governing your use of Selden Ink services, including SMS appointment messaging, deposits, and the studio experience.

1. Acceptance of Terms

By accessing or using Selden Ink's services ("Services"), including this website, online booking, SMS appointment communications, and in-person tattoo services, you ("Client", "you") agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the Services.

2. Eligibility (18+)

State law requires all tattoo clients to be at least 18 years old. By booking or receiving services, you confirm you are 18 or older and will present valid government-issued photographic identification at the studio prior to any procedure.

3. Bookings, Deposits, and Cancellations

All appointments require a non-refundable deposit applied to the final balance.
Cancellations or reschedules with less than 48 hours notice forfeit the deposit. Force majeure cases are evaluated case by case.
No-shows forfeit the deposit and may require a new deposit before rebooking.
Designs, sessions, and pricing are agreed in writing or via SMS prior to the appointment. Day-of changes may incur additional fees or require rescheduling.

4. Health, Aftercare & Liability

You agree to complete a health intake form honestly disclosing any medical conditions, allergies, medications, pregnancy, or recent illness that may affect the procedure or healing.
You will follow the aftercare instructions provided by the artist. Failure to follow aftercare may result in infection, scarring, color loss, or other complications and is your sole responsibility.
Tattooing carries inherent risks; results vary based on skin type, healing, sun exposure, and aftercare. Healed results may differ from initial appearance.
You release Selden Ink and its artists from liability for outcomes related to your skin's individual response, undisclosed conditions, or failure to follow aftercare.

5. SMS / Text Messaging Program (A2P 10DLC)

Program name: Selden Ink appointment notifications. Operated under a registered A2P 10DLC Low Volume Standard Brand with The Campaign Registry (TCR) via Twilio.

What you opt in to: You are added to these messages only by ticking the SMS consent box yourself, on the booking form or an artist inquiry form at our website. It is never ticked for you, and consent is not required to book. Having ticked it, you agree to receive transactional SMS messages from Selden Ink including appointment confirmations, 24-hour reminders, 1-hour reminders, cancellation notices, artist-running-late notices, and occasional service follow-ups.

Message frequency: Message frequency varies based on your bookings and account activity — typically 1 to 5 messages per appointment. Average client receives 4–12 messages per year.
Your information: No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent are not shared with any third party.
Consent is optional: Consent to receive SMS is not a condition of any purchase or of booking an appointment.
Message and data rates may apply. Your mobile carrier may charge for messages received. We do not charge for SMS itself.
Carriers supported: All major US carriers (AT&T, Verizon, T-Mobile, etc.) per A2P 10DLC registration.
Delivery is not guaranteed: Carriers are not liable for delayed or undelivered messages. We cannot guarantee that every message will be delivered, so please do not rely on SMS alone for a time-critical change to your appointment — call the studio.
To opt out at any time: Reply STOP, UNSUBSCRIBE, CANCEL, END, or QUIT to any message. You will receive one confirmation and no further messages. To resubscribe, reply START.

No marketing without separate consent: This program covers appointment-related messages only. Promotional messages (sales, new artists, events) require a separate explicit opt-in.
Phone numbers are never sold: Your phone number is used solely for the messages described above. We do not sell, rent, or share phone numbers with third parties.
Privacy: SMS communications are governed by our Privacy Policy.

6. Photography & Intellectual Property

Artists retain copyright in custom designs they create. You receive a personal license to wear the design as a tattoo; you do not receive commercial reproduction rights.
We may photograph completed work for portfolio, social media, or marketing. Photos identifying you require separate written consent collected at the studio.
You may request that your tattoo not be photographed or published; we will honor that request and note it in your file.

7. Payment Terms

Deposits and final balances are billed in advance or at the session. All fees are non-refundable except as required by applicable law or under our 48-hour cancellation policy. Payment methods accepted: major credit cards (via Stripe), cash, and approved digital wallets.

8. Acceptable Use of this Site

When using this website, you may not: (a) attempt to access accounts or data other than your own; (b) reverse-engineer or interfere with the platform; (c) submit false or misleading booking information; (d) use the Service for unlawful purposes; (e) interfere with or disrupt the Service or its infrastructure.

9. Data and Privacy

Your use of the Services is also governed by our Privacy Policy. You retain ownership of your data. We process data only as necessary to provide the Services and as described in our Privacy Policy.

10. Termination

Either party may terminate this agreement at any time. You may opt out of communications using the instructions in Section 5. We may refuse service for safety, legal, or policy violations. Upon termination of any account-based features, your data is handled per our Privacy Policy retention schedule.

11. Limitation of Liability

To the maximum extent permitted by law, Selden Ink and its artists shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues. Our maximum aggregate liability for any claim shall not exceed the total amount you paid in the 12 months preceding the claim.

12. Governing Law & Dispute Resolution

These Terms shall be governed by the laws of the State of New York, United States, without regard to conflict-of-law provisions. Any dispute shall be brought in the state or federal courts located in Suffolk County, New York, and you consent to that jurisdiction.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or website notice at least 30 days before taking effect. Continued use of the Services after changes take effect constitutes acceptance.
